CE AUDIT

The Legislative Decree no. 626/94 had a simplistic view of the CE Marking. That is to say that the end user only had to test for the presence of the CE Marking machines. With the Legislative Decree no. 81/2008 is a fundamental innovation was made. Namely that the burden of verifying that a machine conforms to the Machinery Directive is the end user.

THESE ARE JUST SOME OF THE QUESTIONS THAT WOULD NEED TO ARISE

In order to ensure the equipment to comply to the same RES it should be subjected to a security audit before it is shipped by the supplier. This audit covers only the safety aspects. Often the customer upon receipt of delivery check that it complies with the order and performs a quality audit and engineering.

Combining the two audits would result in a cost advantage. Any problems may arise when the equipment is still by the supplier and could be resolved directly in the equipment installation phase at the customer.

PROJECT MANAGEMENT FOR THE INSTALLATION OF COMPLEX MACHINERY

Taking into account the definition of the car as a whole Directive Machinery factory could be considered as a complex set of machines and therefore subject to the Machinery Directive.

Even when the whole complex of machines is made by the end user and will never put on the market shall apply the obligations to draw up the Technical File, the Declaration of Conformity and to affix to the Declaration of Conformity.

They can be identified two different scenarios.

1) New machinery
Two or more machines are combined to make a new one. Each machine is accompanied by the Declaration of Conformity or Incorporation. The Machinery Directive requires a "person responsible" to ensure that the set of the two machines is in accordance with the Directive itself and is safe. Practically this means to make the assessment of risks, ensure compliance with the essential safety requirements, produce a technical file and affix the CE Marking.

2) Existing machinery
Two or more machines are combined to make a new one. Each machine is previously in the application of the Machinery Directive. The Machinery Directive requires a "person responsible" to ensure that the set of the two machines is in accordance with the Directive itself and is safe. Practically this means to make the assessment of risks, ensure compliance with the essential safety requirements, produce a technical file and affix the CE Marking.

STEPS TO BE ABLE TO CE MARK A MACHINERY

The steps to be able to CE mark a machine are:

  • make a risk assessment;
  • evaluate the essential safety requirements;
  • produce the technical file;
  • draw up the Declaration of Conformity;
  • affix the CE Marking.


For many machines (excluding those listed nell'Alegato IV of the Directive) the manufacturer can make a self-declaration. For machines listed in Annex IV is necessary instead the intervention of a Notified Body even though the Directive 2006/42 / EC allows a manufacturer the road of self-certification if the same manufacturer fully guarantee the correspondence with the standard type C applicable (of course this applies only in cases where there is a rule of type C and the same applies covers all applicable Essential Safety Requirements).

THE NEW MACHINERY DIRECTIVE (Directive 2006/42/CE)

The need of the Machinery Directive stems from both the growing market of machines in the European Community and by the increasing need to focus on the health and safety of workers who use them.

  • we are able to stay current, informed and compliant?


Responding to these two simple questions every company is able to decide whether it is necessary and convenient to take the outsourcing.

WHAT ARE THE MAJOR CHANGES MADE BY DIRECTIVE 2006/42/EC TO THE PREVIOUS DIRECTIVE 98/37/EC

The non-exhaustive list of the main differences between the two Directives are:

  • on the Declaration of Conformity must bear the name of the "person authorized to compile the technical file".
  • Manufacturers outside the European Union are obliged to give a written mandate to a "Mandatory" in the Community.
  • The scope is expanded. In addition to machinery and partly completed machinery in the field of application you are also interchangeable equipment, safety components, lifting accessories, chains, ropes and straps and the removable mechanical transmission devices.
  • They have changed many Essential Safety Requirements (RES) and many are in addition to previous ones. NEW MACHINERY DIRECTIVE (DIRECTIVE 2006/42/EC) - ARE YOU ALREADY COMPLIANT?

The new Machinery Directive shall enter into force 29 December 2009 without providing for a transitional period. That's why all companies should schedule it to come into force well in advance.

In many parts of the Directive have been made radical changes. All those involved in the application of the Directive are to verify compliance with the new features and the essential safety requirements including those which take into account the control systems.

In order to help businesses of any size to verify their compliance with the Directive it is crucial from definitions. For example, the definition of machine includes "an assembly, fitted with or intended to be fitted with a drive system other than human or animal effort, consisting of linked parts or components, of which at least one mobile, which are joined together for an application well determined ". Also interchangeable equipment is defined as a "device that, after the commissioning of a machine or a tractor, is assembled with that machinery or tractor by the operator himself in order to change its function or attribute a new function in so far as this equipment is not a tool".

Another imported definition is that of partly completed machinery which are defined as those "assembly which is almost machinery but which, alone, are not able to perform a specific application. A drive system is partly completed machinery. Partly completed machinery is only intended to be incorporated or assembled with other machinery or other partly completed machinery or equipment, thereby forming machinery to which this Directive ".

It is also to be noted as fall within the definition of machine also sets of multiple machines that are managed by a control system as if they were a single set - for example a production line.

The scope is expanded. In addition to machinery and partly completed machinery in the field of application you are also interchangeable equipment, safety components, lifting accessories, chains, ropes and straps and the removable mechanical transmission devices.

Obviously the safety and health of workers in the workplace is the primary goal of the employer when a new machine is installed: But do not forget that the Machinery Directive specifies certain obligations that are sometimes very strict and in addition to those the regulations for health and safety in the workplace.

All European Directives are transposed into Italian and often provide a range of sanctions that can be criminal and / or administrative or financial.

In Italy the Directive 2006/42/EC was implemented by Legislative Decree no. 17/2010 which provides for penalties applicable to infringements of national provisions transposing the Directive as well as taking all necessary measures for its implementation. Sanctions are, as required by the Directive, effective, proportionate and dissuasive”

Therefore, care must be taken to ensure compliance with the Directive. This means fulfilling the following four points:

  • be able to demonstrate conformity with the essential safety requirements;
  • make a proper and comprehensive risk analysis;
  • properly prepare the Declaration of Conformity or Declaration of Incorporation;
  • affix the CE marking on the machines.

 

It should be noted that the Directive does not only refer to a single unit, but also involves the processes and systems. If therefore you have been made a complex set, as for example a production line, integrating between them more existing machines also have in fact been made a new machine and then the whole will conform to the Machinery Directive.

Similarly changing the performance or intended use of a machine or a complex set you configure the construction of a new machine that must comply with the Machinery Directive.

The changes to the essential safety requirements made by the new Directive are too numerous to be listed here. The major changes include: ergonomics, control positions, lighting, manual controls, the machine start-up, the machine's stability, security systems, operating instructions in addition to special specifications for the food and cosmetic industries and pharmaceuticals.

NEED TO BE COMPLIANT

There are also changes regarding the Declaration of Conformity. The "person authorized to compile the technical file" should be established within the European Community. Where necessary the Declaration of Conformity must include any other applicable Directives. It is also no longer expected a specific declaration for safety components.

There are of course many other aspects of the new Machinery Directive which is vital that every organization occur in order to have guaranteed compliance with the Directive itself. It is also, however, it points out that there are many other fundamental standards to ensure compliance of a machinery.

The standard 954-1 Safety of machinery - Safety-related parts of control systems will be replaced by EN ISO 13849-1 at the end of 2011 (further extended from December 2010). The designers of control systems can then choose to apply EN ISO 13849-1 or EN / IEC 62061 to ensure compliance with the Machinery Directive.

THE STANDARD EN ISO 13849-1

EN ISO 13849-1 uses a four-step process for the design of control systems related to security:

  • perform risk analysis (using the EN ISO 12100);

DIRECTIVE 2014/34/UE OF THE PARLIAMENT AND OF THE COUNCIL OF 23 MARCH 1994 ON THE APPROXIMATION OF THE LAWS OF THE MEMBER STATES CONCERNIGN EQUIPMENTS AND PROTECTIVE SYSTEMS INTENDE FOR USE IN EXPLOSIVE ATMOSPHERES

The Directive applies to equipment and protective systems (mine materials and surface), electrical and non-electrical, intended for use in potentially explosive atmospheres and the devices used outside of explosive atmospheres, but that affect the devices therein installed.

The Directive does not apply:

  • medical equipment;
  • to equipment and protective systems used in environments where there are explosive or unstable chemical substances;
  • to seagoing vessels and mobile offshore units;
  • certain means of transport.


Where equipment and protective systems must meet the essential requirements of safety and health, classified in three categories:

  • common requirements for equipment and protective systems;
  • additional requirements for appliances that can cause an explosion;
  • additional requirements for protective systems.

 

Procedures in order to obtain the CE mark of conformity depend on the unit and the assured safety. The Directive sets out the procedures to be followed for the various categories of equipment and protective systems intended for use in explosive atmospheres. These devices are characterized by a progressive level of protection that determines the type of procedure to be followed.

Some of the assessment and verification of equipment and protective systems are undertaken by a notified body; A list of these bodies and the tasks for which they have been notified, is published in the Official Journal of the European Communities, in addition to their identification numbers and the tasks for which they are notified. Also, for some categories of well-defined compliance, there is provided a series of procedures ranging from unit verification to internal control of production by the manufacturer.

The CE conformity marking must be affixed to a visible material along with the identification number of the notified body where that is involved in the production control phase. You can other markings on equipment always concerned that they do not reduce the legibility of the CE mark.

Where equipment and protective systems which comply with the Directive, bearing the CE mark of conformity, are considered suitable for release into free circulation in the European markets. However, they can be withdrawn from the market if they are likely to jeopardize the health of people, animals or property.

During a transitional period until 30 June 2003, Member States shall permit the placing on the market and putting into service of devices complying with the rules in force in their territory on 23 March 1994.

This Directive repeals, with effect from 1 July 2003, the following guidelines:

  • 76/117/EEC (electrical equipment for use in potentially explosive atmosphere);
  • 79/196/EEC (electrical equipment for use in potentially explosive atmospheres employing certain types of protection);
  • 82/130/EEC (electrical equipment for use in potentially explosive atmospheres in mines susceptible).

DIRECTIVE 2014/68/UE OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL OF 29 MAY 1997 ON THE APPROXIMATION OF THE LAWS OF THE MEMBER STATES RELATING TO PRESSURE EQUIPMENT

The Directive applies to the pressure equipment and assemblies with a maximum allowable pressure (PS) is greater than 0.5 bar.

It determines the objectives or "essential requirements" to be met during manufacture and before being placed on the market, the above equipment; these requirements replace the corresponding national provisions.

Certain provisions of Directive 76/767/EEC on the approximation of the Member States relating to common provisions for pressure vessels and methods for inspecting these appliances (Official Journal L 262, 27.9.1976) are no longer applicable as of November 29, 1999 for equipment and assemblies covered by Directive 2014/68/UE.

The European standardization bodies shall establish harmonized European standards on the basis of the essential requirements. These rules, which are non-mandatory, will be published in the Official Journal of the European Communities.

The assessment of conformity with the essential requirements of the pressure equipment are based on a modular approach described in Decision 93/465 / EEC on the assessment of compliance and the rules for the affixing and use of the CE conformity marking. The conformity assessment is the responsibility of the bodies designated by Member States in accordance with minimum assessment criteria and that have been notified to the Commission and other Member States.

The assessment procedures are a function of the danger inherent in the pressure equipment. Each category of pressure equipment is accompanied by an adequate procedure or a choice between different procedures of equivalent standard. As for the sets, their compliance shall be subject to a comprehensive assessment procedure.

If the materials used for the manufacture of pressure equipment is not subject to a harmonized standard, at the request of one or more manufacturers of materials or equipment you may be issued the European approval of materials. This document certifies the conformity of the types of material with the essential requirements of this Directive. The list of these approvals is published in the Official Journal of the European Communities.

Before they are placed on the market, the pressure equipment must be fitted with the "CE" marking of conformity, which consists of:

  • a single design, the initials "CE";
  • the identification number of the notified body involved at the production control phase;

 

and to verify compliance with the provisions of this Directive and other relevant Directives relating to the affixing of the CE marking.

On these equipment or assemblies it may be affixed provided that any other mark does not cause confusion with the CE marking.

Member States shall determine penalties if they or notified authorities find the wrongly affixed CE marking.

DIRECTIVE 98/106/EEC OF 21 DECEMBER 1988 ON THE APPROXIMATION OF LAWS, REGULATIONS AND ADMINISTRATIVE PROVISIONS OF THE MEMBER STATES RELATING TO CONSTRUCTION PRODUCTS

It was amended by Directive 93/68/EEC of 22 July 1993.

The Directive applies to construction products, defined as products intended to be incorporated permanently in construction works.

It requires compliance with the essential requirements: the construction products may be marketed only if they are fit for the intended use. In this respect, they must allow the construction of works that meet, for a period of economically acceptable life, the essential requirements of mechanical resistance and stability, safety in case of fire, hygiene, health and environment, safety in use, protection against noise, energy economy and thermal insulation provided for in Annex I to Directive.

 

The essential requirements are defined in the first instance in interpretative documents drawn up by technical committees and are then developed through specific techniques that may include:

  • European harmonized standards adopted by European standardization bodies (CEN and / or CENELEC) a mandate from the Commission and after consulting the Standing Committee on Construction;
  • European technical approvals to assess the suitability of a product for the intended use in cases where there is no harmonized standard, nor a recognized national standard, nor a mandate for a European standard and where the Commission, after consulting the Member States in the Standing Committee on construction, that can or can still develop a standard. To facilitate this, the "European Organization of Technical Approvals" (European Organisation for Technical Approvals), which brings together the relevant national bodies for approvals, may develop guidelines for European technical approval for a product or family of products as construction, under mandate from the Commission and after consulting the Standing Committee on construction.


Where there are neither a European standard or a European technical approval, the products may continue to be assessed and marketed in accordance with existing national provisions conforming to the essential requirements.

Apposition of the "CE" mark: can benefit from the "CE" mark only the construction products comply with the national rules where the harmonized standards have been implemented, a European technical approval or, failing that, to the national technical specifications meeting the essential requirements . The works bearing the "CE" mark meet thus the essential requirements.

Dclaration of conformity: it is up to the manufacturer or his authorized representative in the Community attest, by their own means or by an authorized certification body, that their products comply with the requirements of a technical specification in accordance with the compliance procedures mentioned in the Directive. Those procedures should be determined by the Commission after consulting the Standing Committee on Construction, in accordance with the particular characteristics of a given product or family of products.

Safeguard clause: the products that comply with the Directive but which do not meet the essential requirements and therefore pose a danger to the safety and health, may be temporarily withdrawn from the market by the Member States. Where non-compliance is due to technical, application or shortcomings of the same specification, the Commission will decide, after consulting the Standing Committee on Construction, whether the European or national technical specification should or not to continue to benefit from presumption of conformity.

The Annexes to Directive contain detailed information on:

  • essential requirements;
  • European technical approvals;
  • certificate of conformity with the technical specifications: methods of control of compliance, systems of attestation, competent bodies, trademark, certificate and EC declaration of conformity;
  • inspection and certification bodies and testing laboratories.

 

"CE marking": This Directive amends the provisions of Directive 89/106/EEC and Directives 87/404/EEC, 88/378/EEC, 89/336/EEC, 89/686/EEC, 89/392/EEC, 90/384/EEC, 90/385/EEC, 90/396/EEC, 91/263/EEC, 92/42/EEC and 73/23/EEC as regards the labeling of products. By now the term used is "CE marking".

The conditions for the affixing become the same for a number of products (construction products, simple pressure vessels, personal protective equipment, toys, telecommunications terminal equipment, hot-water boilers, electrical equipment, ...) that can fall simultaneously within the scope of various directives which until that time had planned to different marking systems.

Electrical safety testing:

ELECTRICAL TESTS ON MACHINES AND ELECTRICAL PANELS

The Essential Requirement 1.5.1 Security. "Electricity" in Appendix I "essential safety and health requirements for the design and construction of machinery and safety components" of the Legislative Decree no. 17/2010 "Implementation of Directive 2006/42 / EC on the machinery and amending Directive 95/16 / EC on lifts. on the noise provides that:

"If the machine is powered by electricity, it must be designed, constructed and equipped so as to prevent or be suitable for preventing all hazards of an electrical nature.

Annex III "Internal control of production" in Section 3 of the law 18 October 1977 n. 791 - "Implementation of the Council Directive of the European Communities (n. 2006/95/EC) on safety guarantees that must possess the electrical equipment designed for use within certain voltage limits." about electrical safety provides that:

"The technical documentation must allow assessment of the conformity of electrical equipment with the requirements of the law. It must, to the extent necessary for such assessment, cover the design, manufacture and operation of the electrical equipment, it contains:

  • the general description of the electrical equipment;
  • conceptual design and manufacturing as well as diagrams of components, sub-assemblies, circuits;
  • descriptions and explanations necessary for the understanding of said drawings and schemes and the operation of the electrical equipment;
  • a list of the standards applied in full or in part, and descriptions of the solutions adopted to meet the safety aspects of this case have not been applied the rules;
  • the results of design calculations, examinations carried out, etc .;

7. Data transfer
The Controller does not transfer personal data to third countries or to international organizations.
However, it reserves the right to use cloud services; in which case, the service providers will be selected among those who provide adequate guarantees, as required by art. 46 of the GDPR.

8. Rights of data subject
With reference to the articles 15 (right of access), 16 (right to rectification), 17 (right to erasure), 18 (right to restriction of processing), 20 (right to data portability), 21 (right to object), 22 (right to object to automated individual decision-making) of the GDPR, and to the art. 13 of the Privacy Code, the data subject may exercise his rights by writing to the Controller at the address above, or by email, specifying the subject of his request, the right he intends to exercise and attaching a photocopy of an identity document that certifies the legitimacy of the request.
For your convenience, the contents of the Art. 15 of the GDPR is shown below.
Art. 15 Right of access by the data subject
1. The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information:
a) the purposes of the processing;
b) the categories of personal data concerned;
c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
e) the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
f) the right to lodge a complaint with a supervisory authority;
g) where the personal data are not collected from the data subject, any available information as to their source;
h) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
2. Where personal data are transferred to a third country or to an international organisation, the data subject shall have the right to be informed of the appropriate safeguards pursuant to Article 46 relating to the transfer.
3. The controller shall provide a copy of the personal data undergoing processing. For any further copies requested by the data subject, the controller may charge a reasonable fee based on administrative costs. Where the data subject makes the request by electronic means, and unless otherwise requested by the data subject, the information shall be provided in a commonly used electronic form.
4. The right to obtain a copy referred to in paragraph 3 shall not adversely affect the rights and freedoms of others.

9. Withdrawal of consent
With reference to article 6 of the GDPR, the data subject can withdraw at any time the consent given without prejudice to the lawfulness of the processing based on the consent given before the withdrawal.

10. Automated individual decision-making
The Controller does not make processing consisting of automated decision-making processes on the data processed.
